Implications of using artificial intelligence for personal data protection in Brazil

Abstract

The growing use of artificial intelligence (AI) presents significant challenges for personal data processing in Brazil, particularly in light of the General Data Protection Law (LGPD). This study aims to identify the main implications of AI use for privacy and data protection. The proposed research adopts an exploratory and descriptive approach, beginning with a literature review to construct the theoretical framework for artificial intelligence and automated decision-making. Subsequently, a survey was conducted with data protection professionals, comprising ten statements that were evaluated by respondents on a five-point Likert scale. Following data analysis, the key topics identified were further explored through interviews with experts in these fields. The results indicate that using AI in Brazil raises concerns about personal data protection, as evidenced by transparency challenges and algorithmic biases highlighted in this study. Although the LGPD guarantees the right to explanation and the right to review automated decisions, it faces limitations due to a lack of clear definitions for these processes, potentially undermining the effective application of the legislation. Thus, this research contributes to a deeper understanding of the implications of AI use for privacy and the responsible governance of this technology.
